The
EC EuroCourt will discus the case of a man who has incurred a penalty for
taking part in meeting.The member of "Republic" party’s city
soviet Armen Mkrtchian has recently received the letter of the representative
of department of transactions in EC EuroCourt of Human Rights Mark Velliger in
which the latter notifies about accepting Armen Mkrtchians’s suit as an execution
and discussing it in legal form in coming days.Armen Mkrtchian according to
"RA code on administration infringements" has been taken to police station
on the 14 of May 2002 for taking part in opposition meeting and procession and
in the night legal procedure was fined 500 drams as a result. He was the unique
RA citizen who had been imposed an administrative penalty that managed to pass
through all justice institutions of RA with his insistence protesting and contesting
in the court of original jurisdiction of Center and Nork-Marash communities the
legality of his resolution. A. Mkrtchian applied to EuroCourt in autumn 2002 to
contest the illegality of his resolution.On the 12 of October in 2004 the
president of the Chamber of EC Euro Court of Human Rights made a decision to show
Armen Mkrtchian a juridical assistance and listen to his suit in legal form. According
to the same letter EC will pay that suit’s outlay of A. Mkrtchian and his plenipotentiary.
The day of the court examination will be set in spring 2005. We found out
from the interview with our interlocutor that in case of complying with his suit
in the result of the court examination in EuroCourt the illegal resolutions of
Armenian judges will cost to Armenian budget at least 180-200 thousands Euro.
According to the member of "Republic" party’s city soviet Armen
Mkrtchian’s admission this is, certainly, painful for him but this is also positive
as regards to precedent. We must remind that one of the EC requests that have
been recorded in the last two resolutions on Armenia by the PC of that organization
is the transformation of the "administration code". The request isn’t
