“They want Vardan Petrosyan to stay in custody longer”

The aggrieved Hakobyans filed a complaint with the Court of Cassation

Today, Ruben Baloyan, representing the interests of the aggrieved Hakobyans, made an appeal to the Court of Cassation for Vardan Petrosyan’s case. Note that the Court of Appeal has left the sentence passed on January by the Kotayk marz Court of First Instance unchanged, according to which, Vardan Petrosyan was sentenced to 5 years imprisonment and was deprived of the driving license for 2 years. Hakobyan’s claim to the Court of Cassation is the same as that of the Court of Appeal: not 5 but 6 years in prison and not 2, but 3-year driver’s license revocation.Nikolay_Bagdasaryan-3

Note also that after entering the verdict into effect, Vardan Petrosyan has to take the punishment in an open-type regime zone, as provided for negligent crimes. In the interview with Aravot.am, Vardan Petrosyan’s lawyer Nikolay Baghdasaryan said about the Hakobyan’s appeal to the Court of Cassation, “Their goal is one – to keep Vardan Petrosyan in custody longer. In other words, after the appellate decision enters into force, Vardan Petrosyan should take the punishment in an open-type zone, in outdoors. They appealed to the court to keep him longer in detention. There is no other problem. Now, when they appeal, the Court’s decision will not enter into force, and Vardan Petrosyan will remain in custody.”ruben-baloyan

In this regard, Ruben Baloyan told us, “Nikolay Baghdasaryan is sadly mistaken. We do not pursue such a goal to keep Vardan Petrosyan longer in detention. Our goal was to reach reimbursement of the damage caused to Tatevik Hakobyan. If Vardan Petrosyan expressed his desire at the Court of Appeal to meet the costs for Tatevik’s treatment, and then he refused, how would you explain this?” Mr. Baloyan said that Vardan Petrosyan has announced at the court that he is willing to cover all the medical expenses for Tatevik without a reservation. “Now, the moment has comes that we already reach an agreement, we actually refuse the claim of 8.7 million drams, we say, well, take care, we do not want money, treat her. We have just put a task before them that the treatment should be carried out until the full recovery and restoration of function, but it seems that they did not like that we have put such a task before them. We have said to sign a tripartite agreement: Vardan Petrosyan-healthcare provider-Tatevik Hakobyan. We have said that Tatevik should also be a party of the agreement and that you should cover all the costs until the full recovery and restoration of functions. I realized that they are bothered about the disorder of functions because this girl has a problem and we do not ask for this money just formally that Nikolay Baghdasaryan wants to discredit the aggrieved. We are saying that we do not need money, you have said, so treat”.

To the observation of Aravot.am that N. Baghdasaryan assured that they do not give up with the willingness to treat, and do not see the need for the tripartite agreement, and are ready to take over Tatevik Hakobyan’s treatment, Mr. Baloyan said, “If you are just, what’s the difference for you whether the agreement is tripartite or bilateral. Let them sign an agreement.” Ruben Baloyan expressed an opinion that their appeal will not be accepted as proceedings. “We should consume our complaints in all instances of Armenia, after it, we will appeal to the European Court.”
