PACE today expressed deep concern about the number of Court judgments pending before the Committee of Ministers – nearly 10,000 – despite some progress, and even though all these judgments are not at the same stage of implementation.
The resolution adopted on the basis of the report by Pierre-Yves Le Borgn’ (France, SOC) mentions “serious structural problems” experienced by Italy, the Russian Federation, Turkey, Ukraine, Romania, Hungary, Greece, Bulgaria, the Republic of Moldova and Poland, which have the highest number of non-implemented judgments.
Parliamentarians said that the difficulties in implementing certain judgments revealed “pockets of resistance” in particular concerning political issues.
As well as delays in implementing the Court’s judgments, and the lack of political will to implement them on the part of certain States Parties, the Assembly deplored all the attempts made to undermine the Court’s authority and the Convention-based human rights protection system.
PACE has therefore once again called on the States Parties to fully and swiftly implement the judgments and to co-operate with the Committee of Ministers, the Court and the Department for the Execution of Judgments as well as with other Council of Europe organs and bodies. It also recommends condemning any kind of political statement aimed at discrediting the Court and calls for the establishment of parliamentary structures to ensure monitoring of the obligations stemming from the Convention.
