CONSTRUCTIVE DISTRUST

The
standpoints of the authority, opposition and the Commission of Venice fit but
partly.Yesterday during the press interview the deputy of "Justice"
group Shavarsh Kocharian marked the progress conclusion of the commission of Venice
in this way; "Do you know what a situation is, when a pupil with the lowest
marks writes a better work and both the teacher and the pupil are satisfied. And
now it is approximately that situation. I consider this offensive because this
is our country after all." Mr. Kocharian said that their suggestions in that
work had been adopted partly. And to the question if the "Justice" will
take part in the sitting on 29 of August and the discussions of Constitutional
amendments Shavarsh Kocharian answered; "But sorry, our announcement hasn’t
been changed and we have the same opinion, we have clearly mentioned some mechanisms,
for example constructive distrust, formation of the Government by law to specify
the appointment of judges and bodies of local self-governing. Here it is".
Will the "Justice" take part in the sitting on 29 of August Mr. Kocharian
didn’t give a concrete answer again: "Our announcement is valid, give that
question to the authorities, ask if they are satisfied, will they adopt the demands
of the commission of Venice or not, ask those who are responsible for that project.
And more, the whole logic has been broken that the whole process must be transparent,
open, there must be a public discussion where those discussions are."Shavarsh
Kocharian also said that he had got the impression from Tigran Torosian’s elucidations
on TV as if everything is now OK and they can go for referendum. But Mr. Kocharian
doesn’t think so. "First of all the Commission of Venice has marked only
those positions which were arranged on 23-24 of June in Strasbourg and there are
also omissions. And it is mentioned in the last conclusion that all previous conclusions
and approaches are valid." Shavarsh Kocharian continued that the standpoints
of the opposition and the Commission of Venice are the same. He reminded their
standpoint on the formation of the Government; "If the project of the Prime
Minister who is appointed by the President isn’t approved then the turn must be
given to the NA or to give a right of vote of no constructive confidence. The
Commission of Venice has mentioned that according to the appraisals of the experts
this is effective as it stabilizes the Government. Yes, it stabilizes the Government
but it isn’t the only reason. There are two important reasons. One is that when
the President can produce to the PM for two times and isn’t adopted that candidacy
for two times then he liquidates the NA. According to the project of the Coalition.
What does the constructive distrust give" This will exclude for the President
to give such games. This is very important in our conditions." Next observation
was about that the Government must be formed not by the President’s order but
by law. According to Mr. Kocharian the Commission of Venice and the opposition
are worried about judicial authority. Only the standpoints on local self-governing
aren’t the same that is the matter of the electing way of Yerevan mayor. Venice
thinks that it can be in electoral way or can’t.The "Republic" party
affirmed its decision about not taking part in the constitutional discussions
last week by the letter of the leader of the party city soviet Aram Sargsian where
it is said: " the Republic party hasn’t taken part and won’t take part in
the discussion of the Constitution neither in the NA nor anywhere, neither in
July nor in August. This is a principle decision." And the Constitutional
reforms according to the leader of the party city soviet must be realized in Armenia
