NO SETTLEMENT FOR “A1+” PROBLEM

Tigran Ter-Yesayan, the plenipotentiary representative of “A1+” in the European Court of Human Rights, the head of “Forum” law center elucidates.

Gevorg Kostanian, the deputy minister of Justice, RA government’s plenipotentiary representative in the European Court of Human Rights had issued a statement that the written court examination of 33 suits from 200 received from Armenia was almost over, and now they wait for the court decrees. The court will make its first decree received from Armenia till the end of this year. It may be the question of «A1+» TV Company.
But Tigran Ter-Yesayan elucidated that «A1+»\’s court examination wasn\’t over yet: «The process is still on. «A1+» has sent two applications, one of them is about impugnment of results of the contest in 2002, and the second is about the results of contest in 2003». G. Kostanian meant just the same application saying that the whole process of court examination was expired and the decree would be made till the end of the year. The representative of «A1+» informed that their last application was in summer, 2005: «When the court asked our readiness about written or oral participation. We wrote we wanted to take part in listening. But the government is only for written participation.»
The government has produced its position on the second application on September 19, this year. The representative of “A1+” informed that the court had given them time for objections till November 22. It is supposed that the court must make a decision about the second suit and the unification of both suits is possible in one court examination.
Another detail: the European Court of Human Rights have proposed “A1+” to determine the quantity of compensation of material damages, which must also been produced till November 22. Tigran Ter-Yesayan didn\’t mention the amount of money but told an episode from the produced objections. «A1+» has always demanded the NCTR records about decisions. «We have always been refused; both the NCTR representatives and judges were against giving those records to us. While they have sent those records to the European Court. But those aren\’t the same documents we were asking for. We are interested in records of discussions before polling. They don\’t exist. But it is foreseen that the opinion of each member of the commission must be recorded.»
It becomes obvious from these explanations that the «A1+» case will be settled till the end of the year. Perhaps the decision of unification of both applications will be made. But the «A1+» representative is sure that the «final decree will be in favor us as our argumentations and demands are very clear.” Deputy minister of justice marked as «an important achievement» the circumstance that there is no decision against Armenia and our country is in better conditions than Georgia and Azerbaijan are. But the head of «Forum» law center assured: «Decrees about Armenian will be made with a great package.»
