Shushan Doydoyan, “Let’s see whether they will care for the ruling of the Constitutional Court or not”

Shushan Doydoyan, a member of the Council of Information Arguments and the president of the Freedom of Information Center, assessed positively the ruling of the Constitutional Court not to find Article 1087.1 of the Civil Code unconstitutional, “That ruling of the Constitutional Court was predictable, but it would be better if the ruling of the court addressed the National Assembly (NA), rather than the judges. I mean, it would rather be a proposition addressing NA to clarify the article, so that the judges will not be able to interpret that article arbitrarily and subjectively, as it is done. I am afraid that everything said in the ruling was already in the rulings of the European courts, a knowledgeable judge knows all that quite well and could have used that if necessary – it was just reasserted once again. If they didn’t care for the European courts, now let’s see whether they will care for the ruling of the Constitutional Court or not.”

 

According to Shushan Doydoyan, one of the positive things in the ruling of the Constitutional Court was that it was noted that the demand to prove the assessing judgments was impossible or the amount of a compensation should not threaten the existence of a mass media, it should be adequate to the damage, “It was good that the judges paid particular attention to those. I think this ruling will ease the situation, the problem will be eased for some time, but it will not be solved, because that article continues to remain and be in force as bad as it was. They shouldn’t try to fix a badly written regulation through the legal practice, but should amend the law.”
