Getting acquainted with the details of the ANC activists’ trial in the Court of Criminal Appeals, first Human Rights Defender Larisa Alaverdyan has reached a conclusion that the judge wasn’t able to separate from the political system. “Perhaps, there are no instructions, there is the dependence that doesn’t allow to abide by the simplest laws. There is an approach that doesn’t allow one to say that our judicial system is independent from the political system. In this case, seeing this small arguments, either the court is not able to settle them and carry out the proceedings, or provocative steps are taken, which can bring about such situations,” L. According to her, he cannot talk with defendants in a rude or incorrect manner, but: “The activists present in the courtroom would have helped more, if they had refrained from such remarks. Nonetheless, it was an approach taken from the beginning, which allows me to say that the judge’s impartiality isn’t noticeable. He is dependent on certain circumstances, even
if there are no instructions. And secondly, I think that this process is absolutely and inadequately politicized. I am sorry again, because when such cases reach the European Court, the petitioner wins as a rule, the state, the state’s image suffers.”
