“How else can the armed attack be, let them come and explain to me. They say that the weapon was not loaded, it did not have bullets. Ay, if the weapon were loaded and had bullets inside, he would take the weapon, they would not let him shoot, it would be an attempt of murder. But if the weapon was not loaded, and he comes showing everybody how he takes out the weapon and says, where he is, tell Surik that I am going to shoot, to kill all his family, it is Article 137. What is his dispute, I do not understand?”, – so replied the deputy military prosecutor Artak Harutyunyan in a interview with Aravot.am to the arguments presented by Budaghyan’s lawyer Haik Alumyan saying that Artak Budaghyan’s weapon was not loaded, but it was called an armed attack on the house. As we have informed, Haik Alumyan has stated in his press-release that the military Prosecutor’s office is disseminating misinformation and trying to introduce Artak Budaghyan as an aggressor, attacking character aiming to transform from a victim to a protected entity.
As interpreted by the Deputy military prosecutor,- “Artak Budaghyan is charged by Article 137 of the Criminal Code, the content of which is known. Mr. Alumyan when he came up with a motion to stop the prosecution of his client, had rejected the motion, appealed to me, and I also rejected the complaint. The military prosecutor also rejected the complaint rejected by me. The decisions of rejecting the complaints by us, thoroughly and fundamentally stated as to what the commitment of crime stipulated by Article 137 means. It is not just our decision. Once the investigation is over, I already can show with the documents and prove everything I have said to once again ensure the public that we do not disseminate misinformation.” Artak Harutyunyan avoided commenting on the information related to the drugs found in the body of Surik Khachatryan’s son Tigran Khachatryan. “There are circumstances that as of today I consider investigation confidentiality, and I do not want to talk about it. Time will come, and you will get all the comments.” To our question, in other words, you consider the information on availability or absence of the drugs in Tigran Khachatryan’s body confidential, the Deputy military prosecutor replied,- “Now I do not want to make the conclusion of the expert again a subject of public discussion.” To our question whether you admit that there is a distrust in connection with this case and in general in the Military Prosecutor’s Office, Artak Harutyunyan replied,- “I think distrust is created by some people in the result of dissemination of misinformation. We possibly want that the public weighs the pros and cons with messages, and sees that the objective investigation is going on.” We presented Mr. Harutyunyan the comment of Haik Alumyan about the incident that “the first three shootings sound when the incident, in fact, was over, the brothers were already gone, there was no turmoil, nor reciprocal actions.” In addition, Haik Alumyan insists that it was not an armed attack on Surik Khachatryan’s house, because Budaghyan’s were on David Bek Street. The Deputy Military Prosecutor disagreed,- “Then, why did he come to the house with a weapon? It was a territory adjacent to Surik Khachatryan’s private house, it was not a street. There are no other residential houses there, there is a private house with its adjacent territory.”
