Yesterday, Budaghyan’s lawyer Hayk Alumyan raised a question that “if the person shooting at Avetik Budaghyan on top to down direction was not Surik Khachatryan, then who it was.” Then he explained, “The direction of the injury has been a top-down direction. It was said by the forensic doctor and not by me.” To the observation of the advocates of the opposite side that these are assumptions, Haik Alumyan responded as following, “My assumptions, unlike those of my much respected Martin Zilfugharyan and Ruben Sahakyan, are based on the materials of the case. So far, I have not seen the materials of the case that are the foundation of their conviction, if mine is an assumption.”
Khachatryan’s lawyer Ruben Sahakyan, in the conversation with Aravot.am, said the following, “The conclusion of the expert is missing from the criminal case that Avetik Budaghyan was shot from the top direction. Haik Alumyan does not tell the truth. Assumptions are not legal categories, they are always interpreted in favor of the defendant, it is written in the Criminal Code, Article 18, which explains the presumption of innocence. Hayk Alumyan, my dear colleague, does manipulations on the facts. I have described long ago as to what is what. Alumyan presents the facts detached from one another, cut off from the context. If the expert’s conclusion says that the wound tube was from top to bottom, then he says that the shot was from the top, it means the shot was made by the very Surik Khachatryan. Why then Surik Khachatryan and not another person, they are all assumptions, aren’t they?”
In response to our observation that Haik Alumyan makes a reference to expert’s conclusion, Mr. Sahakyan responded as follows, “If Haik Alumyan says that the expert have told that Avetik Budaghyan was shot from the top, then with all my responsibility I declare that the experts have not provided such opinion. Haik Alumyan wants to show that the pre-investigating body was wrong by discontinuing Tigran Khachatryan’s and Zarzand Nikoghosyan’s criminal case, and stopping criminal prosecution against them.”
