Prime Minister’s daughter and her father-in-law see themselves as “recipients of accusations” of “Aravot”

As we have already informed, Prime Minister’s daughter Narine Tigrani Sargsyan and father-in-law Hrant Rafiki Suvaryan have brought a lawsuit at the Arabkir and Kanaker-Zeytun Administrative District Court of First Instance.

On February 7, 2014, Arzvot.am published the article on “The prime minister’s daughter’s and her father-in-law had possessed my property.” In this article, the respondent Susanna Davtyan and Lemberik Khachatryan informed Aravot.am about how the Prime Minister’s daughter and her father-in-law, the Head of Financial Supervision Department at the Central Bank of Republic of Armenia Hrant Suvaryan “illegally took the possession of their stone building.”

Aravot Daily LLC was recognized as the third person of this case. The member of RA Chamber of Advocates Anahit Sargsyan is the plaintiffs’ representative; the third person “Aravot” Daily does not yet have its representative. Simizar Hovsepyan is the judge for this case.

Today, Aravot.am received the 20.03.2014 decision sent by the judge on preliminary court hearing, according to which the preliminary court hearing on the claim to reimburse the damage caused to the honor and dignity of plaintiffs is scheduled for April 18, at 14:30.

In fact, the court was also informed that the respondents Susanna Davtyan’s and Lemberik Khachatryan’s representative Yurik Khachatryan submitted the response of the application. The plaintiffs see themselves as “recipients of accusations” of Aravot Daily (www.aravot.am) publications dated February 7 and February 8.

According to the plaintiffs, “in the said articles, citizens Susanna Davtyan and Lemberik Khachatryan, in their interview to the daily newspaper had publicized certain factual information, which says that Prime Minister’s daughter and her father-in-law took possession of their property, that Prime Minister Tigran Sargsyan’s daughter and her father-in-law, the Head of the Financial Supervision Department at the Central Bank of Republic of Armenia Hrant Suvaryan had illegally taken possession of their stone building. These facts are defamatory, do not meet the reality, and discredit the plaintiffs’ honor and dignity.”

According to the plaintiffs, the respondents have submitted the data in public, through “Aravot” newspaper and web site. “The mentioned actual data are lie; they do not have any ground and are unreliable. And these data discredit the honor and dignity of the plaintiffs, since they are blamed in anti-legal act, illegal possession of another’s property,” says the claim.

Plaintiffs are making reference to RA Civil Code, Article 1087.1, Point 8, under which in case of defamation, the person may demand by court order either a response, or denial, or a compensation to be paid in the amount of up to 2000-fold of the established minimum salary. The plaintiffs are demanding denial of the misinformation in the newspaper and the website by publishing the text of denial presented during the trial in the newspaper, and to obligate the respondents to pay compensation of 300,000 AMD to each plaintiff for defamation, and another 250,000 AMD to the attorney for court representation by each contract until the payments made based on the signed contract.

In fact, the third person recognized “Aravot” turned also to Hrant Suvaryan, who in the conversation with Aravot.am has denied that he is associated with Khachatryan’s stone building. “This land has nothing to do with us, it’s the neighbor’s land, we have nothing to do with it. The house next to this land is my son’s house, whereas Lembrik Khachatryan’s built stone construction, a garage, is located on his neighbor Arthur Khachatryan’s land. They have long ago agreed with each other on the construction. Now, I do not know what problems have emerged, the problems are with them. We have nothing to do with it.” They say that an opportunity was provided in “Aravot” to listen to the second party and to determine who really the recipient of the accusation is.
