The Police representative couldn’t get to the Court session put forward by their claim

On June 18, “RA Police against Levon Barseghyan”, the third preliminary session of the administrative proceeding (№ ՎԴ(Admin.Court)/0026/05/14) about the claim to bring him to administrative responsibility was appointedat the Administrative Court (Gyumri). The session, lasting only seven minutes, was again paused because of the absence of the Senior Legal Adviser of the Central Police Division Lieutenant Colonel Sona Melikyan.

After opening the Court session, the secretary informed that Sona Melikyan had called and said that she is on the way and would be late for 5 minutes. The Court, waiting for 5 minutes, asked the respondent Levon Barseghyan’s opinion on continuing the session, and he states announced that this was an obvious disrespect by the police towards the Court, but he didn’t want the session to be continued unilaterally, so solicited to postpone the session.  The Court reminded that the preliminary session could be held without one side, and the respondent Levon Barseghyan insisted on the necessity of the presence of the Police representative on the claim they had put forward.

The Court decided to postpone the session and inform the two sides about the date and time of the next session with a notification. Even more than 15 minutes after the Court session was closed, the Police representative didn’t arrive at the Court.

Earlier, at the preliminarysession[1] on April 15, 2014 of the same case, Police was absent too, none of the 30-50 thousands RA Police staff members could manage to present the Police in the Court session held by the claim they had put forward.

The Police had prepared and brought lawsuits to the Court against L.Barseghyan and dozens of other citizens after December 2, 2013, the day of V.Putin arrival to Armenia, when all of them and almost 2 thousand other protestors organized and held protest demonstrations and marches in Yerevan against the colonization of Armenia and the concession of sovereignty, and the Police, according to the demonstrators, brutally violating their constitutional rights of freedom of speech, peaceful assemblies, marches, had arrested 110 people and taken them to police stations, keeping them for 3-4 hours.

The preliminary Court session[2]  on 19, May had started late because of the Police representative delay and was interrupted with the respondent’s solicitation on the grounds that the representatives were busy in Yerevan with other Court Cases in which the Police was the plaintiff against several demonstrators arrested on December 2.
