The political analyst about the judgment made by the European Court of Human Rights
The political analyst Gagik Hambaryan, analyzing the judgment of the European Court of Human Rights on “Perinçek v. Switzerland”, said, “I was expecting that the European Court would adopt such a judgment that both the sheep will be alive and the wolves are fed up. In other words, it did so that the score is 1:1 and this fight ends in a draw. Of course, our officials and more of the pro-government analysts loudly state that they met all the requirements of Armenia, the requirements that our country made to this trial were met, and the European Court of Human Rights has not debated it, has not questioned and had no right to question the fact of the Armenian Genocide. I should note that the President of the European Court made this clear.
Certainly, it is very important for us that the Republic of Armenia beats Turkey, but it defeated Switzerland, a country that was one of the first to adopt a law criminalizing the Armenian Genocide. And this law was used against a person who was specifically sent to Switzerland on business by the Turkish authorities. Perinçek was always the biggest opponent of Turkish President Recep Tayyip Erdoğan, one can say, the enemy, and was convicted to many years. But perhaps the Turkish authorities, as agreed, sent this provocative to Switzerland, who loudly stated that there was no Armenian genocide. And now, according to this judgment, the European Court decided that the application of the Swiss law was wrong, there are some gaps. As an Armenian, this judgment is a defeat for me.” Gagik Hambaryan says, we, Armenians, should not think that this is Switzerland’s business, this is whole Armenian’s business because the Switzerland law was specifically passed for the protection of the historical episode of our nation. According to him, Switzerland had no problems with Turkey but passed a pro-Armenian law. Switzerland’s defeat, according to the political analyst, was a dangerous defeat, it can cause problems for the countries that want to adopt a law criminalizing the denial of the Armenian Genocide. According to our interlocutor, France was looking forward to the end of this trial.
“I think that this is a double game, which cannot fully satisfy us, and we should definitely approach it more skilfully and try to find a solution to this issue. Certainly, this judgment is more pro-Armenian than the one passed earlier by the lower court, but I do not want to consider it a victory. This will create problems for the countries that are going to make pro-Armenian decisions and are going to punish those who deny the Armenian Genocide. With this step, the Human Rights Court makes the score end in a draw, we would be very happy if the score were 2:0 in favor of Armenia-Switzerland”, says the political analyst. According to him, 7 of the 17 judges, including the president, voted against meeting the Perinçek claim, presenting substantial explanations. While the judges’ arguments, as Gagik Hambaryan thinks, must be used correctly and diplomatically by the Republic of Armenia.
