The debates on elaborating the new Electoral Code has kicked off. Human rights activist Arthur Sakunts is concerned in this regard. According to him, prior to passing to amending the Electoral Code (EC) and other laws, we must be able to learn from the results of the referendum. The disgrace that that took place and Serzh Sargsyan’s draft constitution, which was imposed both by proposing it and by the referendum, cannot pass without consequences. We are not in a situation that we can speak about the compatibility of the current legislation and the Constitution. As the Electoral Code, then, if we accept that we are ruled by an imposed Constitution, naturally we must make the laws compatible.
No President of Armenia will be elected from now and onward just by elections, the NA will be fully proportional, and we are talking about the formation of a stable majority. EC should provide solutions for local government elections. If we viewed it in the light of legal compatibility, of course, we need these changes in the Electoral Code, but we are not in the situation that we can talk about it. I call this a constitutional crisis, because rules of a game are proposed, which absolutely lack in confidence.” The human rights activist believes that the confidence of Serzh Sargsyan in the constitution is missing, as well as the necessary guarantees related to its compatibility. “We have sufficient grounds to claim that the results of the Constitution were rigged, stuffing took place instead of the absent voters, this issue should become a subject for investigation and a priority rather than amendment of laws.”
