“Turkish lawyer must substantiate that the Bundestag decision violates the rights of an individual.” Vladimir Vardanyan (a video)

As we had reported earlier, a lawsuit has been submitted to the German Constitutional Court to cancel the German Bundestag decision to pass a resolution recognizing the Armenian Genocide. The author is Turkish attorney Melih Akkurt. On June 15, at the press hall of the “Armenpress” news agency, the expert on international laws Vladimir Vardanyan made some observations on this lawsuit. “To achieve success, a person must substantiate that this document has violated one of a number of rights provided for by the Constitution of Germany.

In this case, there is no such problem. The resolution is parliamentary and has no level of law, it cannot violate the rights of an individual, including the Turkish attorney’s who is thus trying to keep the problem in the spotlight. Turkish lawyers have exhausted all possible means to recognize the resolution null and void. At the phase of accepting the lawsuit, the German court will clearly express its position,” -he said. Speaking about the content of the Bundestag document condemning the Armenian Genocide, Vladimir Vardanyan noted that it rather speaks of the German Empire than of today’s commitment of Germany, “It rather speaks of the German inactivity than complicity. I consider it dangerous that the target of the responsibility may transfer from Turkey to Germany as the latter has highlighted its commitment but has not mentioned that it is complicit in the commitment of genocide.”

As for the opinion that Armenia should promptly elaborate the circulation of the bill criminalizing the denial of the Armenian Genocide by Germany in the Bundestag, Vardanyan said that in the European domain, there is no common approach to bring the deniers of the Armenian Genocide to responsibility, which may inhibit the adoption of such laws, “However, a serious process of fight against xenophobia was initiated in the framework of European legal domain, and the denial of the Armenian Genocide can serve as a basis exposing the persons to liability, even in the absence of the relevant law.”
