The Court of Appeals released its decision regarding the deterrence of second President of Armenia Robert Kocharyan. The decision was in agreement with that of the First Instance Court, which is that the decision to detain Kocharyan will remain in effect. This means that Kocharyan will be detained again. His lawyers told reporters that the time when the court’s decision to detain Kocharyan will go into effect is not clear yet. Lawyer Ruben Sahakyan expressed that the court’s decision was based off of the timing of the pre-election campaigns, so that the public will vote for political party number four.
The second President of Armenia has been accused of violating the constitution during the events of March 1st. The Yerevan Court of First Instance, led by Judge Vache Margaryan, made its decision to detain Robert Kocharyan as a deterrence method on July 27th. After this, Robert Kocharyan’s lawyers appealed to the Court of Appeals. The court accepted their appeal, stating that second President Robert Kocharyan has immunity. This decision was again appealed by the General Prosecutor and the plaintiff. The Court of Cassation decided to accept the General Prosecutor’s complaint on November 15th and send the case to the Court of Appeals for a new investigation.
