It is Proposed to Increase the Fine Amounts Designed for Illegally Providing the Information

According to the available statistics, from 2019 till today no answer was submitted in general, to 3% of the inquiries in written form addressed to the information holders, in case of 9% the answers were incomplete, by inquiry some demanded information was not provided, in case of 3%, the information was not provided, in case of decent legal basis designed without law was rejected without basis, and in case of also 3%, an answer without basis was received with avoiding, general formulations, with content not having connection with the demanded information or non-relating references. The RA Deputy Minister of Justice Yeranuhi Tumanyants voiced about this at May 17 sitting of the Standing Committee on State and Legal Affairs.

According to Yeranuhi Tumanyants, the fine amount from ten to fifty thousand AMD does not interest the citizens, sue the legal entities against the officials, being financed from state and local self-government bodies, state institutions, as well as the organizations of public importance for not illegally providing the information prescribed by law.

The Government proposes to amend the Code on the RA Administrative Offences: i.e. to increase the fine amount prescribed by Article 189.7 of the Code for illegally not providing the information prescribed by law: to make the fine from ten-fold up to fifty-fold of the established minimum salary to from thirty-fold up to seventy-fold. In case of again carrying out the same violation during one year after enforcing administrative penalty, make the fine amount from fifty-fold up to hundred-fold of the minimum salary to from hundred-fold up to one hundred fifty-fold.

The Expertise and Analytical Department of the National Assembly Staff presented proposals of technical character on the initiative, which were accepted.

The debated initiative was endorsed in the first reading.

The debate of the bill on Amending the Law on Citizenship of the Republic of Armenia authored by the deputy Gegham Manukyan and the package of bills on Amending the RA Criminal Code and on Amending the RA Criminal Code authored by the Armenia Faction was postponed up to two months because of the authors’ absence.
