Legislative Proposal Aimed at Improving Whistleblowing System

The legislative amendment proposes to extend relations related to whistleblowing to the organizations of the private sector and community organizations, to provide the possibility of whistleblowing, including anonymous whistleblowing, in situations that do not constitute a crime of a corruption nature, establishing a competent body to investigate such whistleblowing cases at the same time.

The amendments proposed to the Law on Whistleblowing System and a number of other ones are conditioned by the need for the development and improvement of the whistleblowing system and the fulfillment of international obligations. The RA Deputy Minister of Justice Yeranuhi Tumanyants presented the problems of the sphere and the new regulations.

The Corruption Prevention Commission will ensure the recording, discussion, taking of measures of every whistleblowing entered into the unified electronic platform within its scope of competence and, if necessary, the initiation of proceedings regarding an administrative offense. It is proposed to clarify the protection mechanisms given to whistleblowers.

The Human Rights Defender, as a competent body, will summarize the relevant statistics on whistleblowing within the framework of the annual report, which will be subject to publication.

A new type of whistleblowing will be provided: whistleblowing to the public. The purpose is to create effective mechanisms in the fight against corruption, ensuring the increase of public awareness.

The Committee Chair of the NA Standing Committee on State and Legal Affairs Vladimir Vardanyan informed that the legislative package will be reviewed within the framework of the working debate between the first and the second reading.

On September 2, the legislative package was debated in the first reading and endorsed at the sitting of the NA Standing Committee on State and Legal Affairs.

The draft law on Making Amendments to the Constitutional Law the Rules of Procedure of the National Assembly authored by the NA deputy Sergey Bagratyan was debated in the second reading and endorsed. According to the draft, the period of authorities of the Investigative Committee will be set up to six months. The period can be extended twice by the recommendation of the Committee and the NA decision for a period of up to six months.

The RA Deputy Minister of Justice Yeranuhi Tumanyants presented for debate in the second reading the bill on Making Amendments to the RA Code on Administrative Offenses. The draft proposes to increase the amount of the fine envisaged by Article 189.7 of the Code for illegally not providing the information provided by the law. The Committee endorsed the issue.
