High risks related to the further operation are revealed while implementing control in the sphere of technical security on the buildings or other facilities by the inspection body with functioning regulations. In those conditions a decision is made to suspend the operation of the given facility, but in practically, the effective mechanisms of ensuring the implementation of those decisions are absent, and the control does not its goal.
The Acting Head of Inspection Bodies’ Coordination Bureau at the RA Prime Minister’s Staff Armen Danielyan informed about this while presenting the legislative package designing addenda and amendments to the laws on Fire Security, on State Regulation of Ensuring Technical Security and on Judicial Acts Compulsory Enforcement. The issue was debated at April 5 sitting of the NA Standing Committee on State and Legal Affairs.
The requirements being presented to the administrative acts, decisions and decrees compelling to carry out certain actions or obligating abstaining from certain actions are specified. The act restricting by the proposing regulation will be subject to be fulfilled from the day of entering into force not late than its complaint does not suspend its action or fulfilment within established term or in order of precedence. In case of not carrying out the administrative acts of the inspection body voluntarily, they will be subject to compulsory enforcement with the order established by law on Judicial Acts Compulsory Enforcement.
The Secretary of the NA Armenia Faction Artsvik Minasyan inquired about the reforms of the inspection system, the possibility of making complex solutions in the sphere and the control after the fire that happened in Surmalu Trade Centre.

The inspection body carries out regular control in the operating part of Surmalu: Armen Danielyan informed about this. He noted that the efficiency of the inspection system and the measures aimed at its fulfilment and added that instead of setting administrative legal offenses we go to setting measures aimed at reducing or eliminating the concrete risk. According to the rapporteur, the debate of the mechanisms characteristic to any case and sphere is purposeful.
“The existing legal gaps will be filled and the control functions being implemented by the inspection body will become more efficient for avoiding the revealed and non-eliminated legal offenses and excluding the dangers threatening to people’s security, life and health by that,” the Committee member Alkhas Ghazaryan noted in her report and proposed the MPs to vote for it.
Arsvik Minasyan emphasized the changes in the sphere of fire security and proposed his colleagues to debate the mechanism of introduction of the risk reduction through accreditation system. It means that the organization with knowledge and experience accredited in the private sector will carry out professional decent assessment in the facility, and the conclusion given by it will become a basis for revision of working programmes of the inspection bodies in the future.
In response, Armen Danielyan mentioned that they don’t hurry to move the function in all direction to accreditation field, as we should understand if the business is interested in entering into that field and take the state responsibility on itself. He informed that at this moment the institute of introducing such system is already observed in the food security. According to the rapporteur, the proposal, in general, is acceptable, steps are taken in that direction.
As a result of voting, the initiative was endorsed by the Committee.
