Deputy Minister of Justice: Members of Anti-Corruption Commission to be appointed for a period of 3 years

The amendments envisaged in the law on the Anti-Corruption Commission refer only to the implementation of disciplinary proceedings in the Anti-Corruption Commission and detail the order regarding this: the RA Deputy Minister of Justice Armenuhi Harutyunyan stated at April 13 NA sitting.

According to her, the law has not established a clear procedure for the implementation of disciplinary proceedings, there are no regulations regarding the proceeding body, the rights of the Commission employee during the proceedings are not regulated.

The draft law proposes to introduce structural regulations for the formation of the Disciplinary Commission in the Committee, in particular, to form a Commission of 8 members. The draft law provides for the inclusive composition of the Disciplinary Commission.

The Deputy Minister informed that the members of the Anti-Corruption Commission will be appointed for a period of 3 years. For the staff members of the Commission, special regulations have been designed from the viewpoint of terms of office.

It was fixed that the two representatives of the anti-corruption policy development body introduced by the Prime Minister will be in office for a period of 2 years, and the investigator chosen by the lottery of the Anti-Corruption Committee, the officer of the operative intelligence unit, as well as the prosecutor presented by the Prosecutor General, will be in office for a period of 1 year.

Armenuhi Harutyunyan also noted that the draft will specify the procedure for applying disciplinary measures. The service examination of the Committee employee will be carried out in two phases: preliminary investigation and disciplinary proceeding, for which 1 month is set. Guarantees for ensuring the rights of the Committee employees were also defined. Regulations of conflict of interests are designed to prevent and exclude possible cases. Circumstances, in the presence of which Commission members will be prohibited from taking part in the Commission’s activity, have been established.

The Deputy Minister informed that the Commission will operate on voluntary basis.

The co-rapporteur, the Chair of the NA Standing Committee on State and Legal Affairs Vladimir Vardanyan mentioned that in order to ensure the effectiveness of the Committee’s activity, it is necessary to envisage appropriate procedures and structures in the field of disciplinary liability. According to him, the draft law was debated in detail in the relevant Committee and was endorsed. The deputy called on to vote for the draft law.
