Legislative initiative aimed at the rise of tax administration efficiency

The goal of the draft law and the enclosed legislative package designing amendments and addenda to the RA Tax Code is the efficiency rise of the administration being implemented by the tax body: The Chairman of the State Revenue Committee (SRC) Rustam Badasyan said this.

“If the taxpayers cause tax obligation with their calculation, naturally, they also should pay within the established term. If they don’t pay, we say with this draft that we’ll remind you about your obligation. If during 7 days they don’t fulfill that obligation, then we make a decision to levy, we prohibit the funds available in the banking account, if there are, the movable and the real estate property, and procedure goes on. If after one month, they don’t cover the obligations or don’t apply, then a schedule will be applied and other measures will be taken, they are sent to enforcement service,” Rustam Badasyan clarified. As he informed, it is designed to remove from the Code also the right of appeal, which the taxpayers often speculate. “That is if it is appealed, its fulfillment will not be suspended,” the SRC Chairman clarified.

According to the substantiation, it will be designed to have procedure of blocking for levying the mentioned obligations in case of emerging non-paid tax obligations, particularly, in the event of suspending the tax obligations within 30 days after imposing lien on the taxpayers’ property, the tax body will submit the information on the decision and the amount of the non-fulfilled obligation to the Compulsory Enforcement Service for enforcement.

As a result of debate, there was a proposal to review the amount of prohibiting sum of money.

It is envisaged that the law will enter into force from January 1, 2025 and will be spread on tax obligations caused after the law entering into force. The Committee endorsed the package.

The legislative initiative was debated at the sitting of the NA Standing Committee on Economic Affairs on January 10.
