As a result of adopting the draft, the status of militiamen as subjects of crimes against the established order of military service will be enshrined by law, which will provide an opportunity to make a proper legal assessment of the violations committed by them and to solve the problems arising in practice.
The package of draft laws on Making Amendments to the RA Criminal Code and on Making Addendum to the RA Law on Defense authored by the deputy Alkhas Ghazaryan was debated at the RA NA regular sitting on January 15.
According to the draft, it is proposed to make appropriate amendments in the RA Criminal Code, clearly establishing that the subject of a crime directed against the established order of military service is also a person considered to be a militiaman. “The issue is relevant at the moment, because a number of criminal proceedings are being investigated in the proceedings of the General Military Investigation Department of the RA Investigative Committee, which refer to the violation of the rule of combat duty or combat service of militiamen. According to the current legislation, the latter are not subjects of a crime directed against the established order of military service, and due to this fact, the criminal proceedings initiated against them are dismissed,” the author of the legislative initiative explained.
The member of the Standing Committee on State and Legal Affairs Arpine Davoyan presenting the endorsement of the Head Committee, proposed to vote for the initiative.
