Case weighting in judicial systems: a new tool for proper functioning of courts

In a report published today, the working group on judicial time management of the European Commission for the Efficiency of Justice (CEPEJ) takes stock of this internal management system aimed at assessing the “weight” of a judicial case, by detailing, through various methods, the judicial time needed for its processing.

The information resulting from the weighting of cases can be used to optimise the allocation of human and budgetary resources within the courts, of judicial cases between judges or to support a broader service management programme.

Based on an extensive review of the existing bibliography on the subject as well as on the methodology used in six European countries, this study makes 12 recommendations for the implementation of a case-weighting system. Among the main conclusions is the need for an active involvement of judges in the process.
