A number of problems arising in practice in civil procedure to be solved, workload of courts to be reduced

The Civil Procedure Code was adopted in 2018. Until now, some amendments have been regularly made in it, but big and systemic amendments in the direction of the actions of the Code and the problems arising in practice have not been implemented, although their necessity has been repeatedly emphasized both by the Government’s programme and by the relevant clauses of the strategy of judicial and legal reforms approved by the Government. This was stated by the Deputy Minister of Justice Armenuhi Harutyunyan during the extraordinary sitting of NA Standing Committee on State and Legal Affairs on December 19, presenting the draft law providing for addenda and amendments to the RA Civil Procedure Code in the first reading for debate. According to the Deputy Minister, as a result of the proposed amendments, a solution will be given to a number of problems arising in practice in civil procedure, emphasis will be put on reducing the workload of the courts, and the possibility of providing better services for citizens.

With the new regulations, the persons participating in the court case will more fully exercise their procedural rights, the notices will also be sent by telephone or internet connection. By sending a message, the courts will be freed from obviously groundless claims.

The Deputy Minister of Justice noted that several amendments are planned from the first to the second reading.

The MPs’ questions related to the necessity of debating the draft in the extraordinary sitting, the amendments under debate, and whether they were debated with the concerned parties.

The co-rapporteur, the Deputy Chair of the Standing Committee on State and Legal Affairs Arusyak Julhakyan mentioned that a large package of amendments was proposed to the Ministry of Justice. The deputy proposed to endorse the debated draft, to organize a work debate during the period from the first to the second reading.

“During the work debate, we will raise all the issues that concern us, we will debate the proposals in detail and we will have a revised version before the second reading of the draft,” the co-rapporteur said.

The Committee endorsed the draft law.
