Legislative initiative aimed at simplifying administration, easing workload of administrative courts

Most of the violations of traffic rules are recorded by means of video recording devices, and under current conditions, it is not justified to allocate around 1.5 billion AMD annually for paper notices. We have designed a possible digital interim solution until the new system of biometric passports and ID cards is introduced and our citizens will have a proper notification system. This was stated by the RA Deputy Minister of Internal Affairs Arpine Sargsyan at the sitting of the RA NA Standing Committee on State and Legal Affairs on February 1.

The draft law on Making Amendments and Addenda to the Code of the Republic of Armenia on Administrative Offenses authored by the Government and the enclosed package of draft laws were debated.

The legislative package includes amendments regarding the fines imposed as a result of the violation of traffic rules, the simplification of administration, as well as the relief of the workload of administrative courts.

Referring to the second important amendment, Arpine Sargsyan noted that there are a number of unexecuted administrative acts worth about 8 billion AMD, which are currently in the Enforcement Service. The RA Deputy Minister of Internal Affairs mentioned that there are similar examples in international practice, when the state, saving administrative resources for the execution of this group of acts, provides a certain bonus system for the citizens. “In our case, the bonus system is as follows: If the citizen pays the set fine within 15 days, then a 30% discount will apply to the fine. In other words, if the fine is paid in the amount of 70%, then we will consider the obligation fully fulfilled,” the Deputy Minister explained.

Detailing a number of other amendments proposed by the legislative package, the key rapporteur stressed that their adoption will reduce the workload of administrative courts as much as possible.

The MPs’ questions were related to the issue of biometric passports and identification cards, the organization of wide-scale awareness campaigns regarding all the regulations of the legislative package.

The co-rapporteur Arpine Davoyan highlighted the proposed amendments.

In their speeches, the MPs emphasized the establishment of justice in the system, the implementation of the electronic notification system, the steps aimed at making road traffic safer. The Chair of the RA NA Standing Committee on State and Legal Affairs Vladimir Vardanyan attaching importance to the necessity for the legislative initiative, emphasized the implementation of digital technologies in the digital era, the steps aimed at reducing the workload of the courts, spoke about the necessity for investment in the multi-channel notification institute.

Arpine Sargsyan, thanking for the comprehensive debate and questions, pointed out that it will help to present the proposed regulations in more detail. She emphasized that the draft aims to improve state-citizen relations, to eliminate the practice of paper notification.

Vladimir Vardanyan informed that the RA NA deputy Arsen Torosyan presented three proposals for revising the package of drafts. In particular, it was proposed to apply two penalty points in case of violations related to non-observance of light transmittance standards.

According to Arpine Sargsyan, the Government does not have a positive conclusion regarding the submitted proposals, stressing that such a point change is an extremely disproportionate approach. The Committee abstained from voting on the proposals presented by Arsen Torosyan.

The legislative initiative was endorsed.
