The Venice Commission has published its opinion on the crime of “materially incentivizing participation in an assembly” (part 2 of Article 236 of the Criminal Code of the Republic of Armenia).
Among other issues, the Commission concluded that, in its current wording, it does not comply with the principle of legal certainty. As a result, organizers of assemblies may be prosecuted for providing material incentives, such as transportation, food, accommodation or covering other organizational expenses of demonstrators, which should not be prohibited.
