The purpose of the Criminal Procedure Code, which entered into force on July 1, 2022, is to establish an effective procedure for conducting proceedings regarding alleged crimes based on the guarantee of rights and freedoms. As such, the implementation of an effective and high-quality preliminary investigation stems from this purpose. It should be noted that the presence of somewhat problematic regulations in the Criminal Procedure Code, which has been in effect for about three years, has created additional obstacles, and this draft law is aimed at eliminating them. The Deputy Chair of the RA NA Standing Committee on Protection of Human Rights and Public Affairs Rustam Bakoyan said, presenting for debate in the first reading the draft law on Making Addenda and Amendments to the RA Criminal Procedure Code at the regular sitting of the NA Standing Committee on State and Legal Affairs on March 18.
The author of the initiative Rustam Bakoyan presented the proposed addenda and amendments and noted that as a result of the adoption of the draft, it is expected to create additional prerequisites for more effective implementation of criminal procedural functions.
It was noted that the draft will regulate specific time and procedural issues in criminal proceedings, which is aimed at an effective, complete, comprehensive and objective examination of criminal proceedings. Furthermore, the draft law is also expected to provide an opportunity for the body conducting criminal proceedings to conclude the proceedings within a reasonable timeframe, within a scope of its jurisdiction.
The Deputy Minister of Justice Gevorg Kocharyan presented the positive opinion of the Government on the draft.
