Amount of state duty applying to court is proposed to raise: it will become 6000 AMD instead of former 1500 AMD

The legislative package on Making Amendments and Addenda to the RA Law on State Duty, on Making Amendment and Addenda to the RA Civil Procedure Code and on Making Amendments and Addenda to the RA Administrative Procedure Code was debated in the second reading at the NA Standing Committee on Protection of Human Rights and Public Affairs at April 5 sitting.

The state duty for the lawsuits being submitted to the court beginning from 1990 has not been changed, but the social-economic conditions in the country have been changed about 4 times. The RA Deputy Minister of Justice Vahe Danielyan noted that in 2018 about 9bln AMD factual expenditures had been made on the courts in 2018, meanwhile 1.7bln AMD appeared to be. 2bln AMD income was received for 12bln AMD in 2019. Presenting the statistics data, the Deputy Minister underlined that study of the international experience was made.

The state duty will become 6000 AMD instead of former 1500 AMD. Maximum amount of the state duty will be established – in the Court of the First Instance it will be 25mln AMD, in the Court of Appeal – 15mln AMD, in the Court of Cassation – 10mln AMD.

Duty formula was established for administrative cases. The system of privileges has been reviewed: there are unsubstantiated privileges in the law. “We have established additional important privileges, and among them are decisions made by the Head of the community on rallies and the issue of complaining the legality of the actions. In that case state duty will not be levied. The state duty will not be levied also in case of submitting lawsuits to the Court on violence cases in the family,” Danielyan clarified.

State duty also will not be levied from the organizations implementing observation mission, the legal violations established by the Electoral code will be disputed in the Court.

A new privilege of the state duty, which relates the relations of getting heritage certificate of the deceased servicemen or died citizens as a consequence of military actions has been added in the law. In that case a privilege of getting exempted from the state duty has been established, too.

In his co-report the RA NA deputy Sargis Khandanyan proposed his colleagues to endorse the amendments.

The legislative package was endorsed by the Committee.
