Legal-organizational unified form to be set for the institutions implementing medical assistance and service in state or community non-commercial organizations

In the primary health care system, the functioning organizations have different organizational –legal forms. Part of the Medical Centres (MCs) carrying out the same function are Community Non-Commercial Organizations (CNCO), the others – the State Non-Commercial Organizations, there are also several Closed Joint Stock Companies (CJSC). At September 7 regular sitting of the RA NA Standing Committee on Health Care, the Committee Chair Narek Zeynalyan said this presenting the package of draft law on Making Addendum to the Law On State Non-Commercial Organizations (SNCO) and on Making Amendments and Addenda to the enclosed laws.

According to the rapporteur, in the local self-government system, conditioned by the community enlargement process, provisions are noticed in the laws in force, which make complicated the management of the medical institutions implementing medical assistance and service. In particular, the in the laws On State Non-Commercial Organizations, On Local Self-Government and On Medical Assistance and Service of Population, as well as in the sub-legislative legal acts stemming from them there are different regulations, which give an opportunity to form unified approach for the choice of the directors of the medical institutions implementing medical assistance and service. Irrespective of the legal-organizational forms of the MCs by the draft, from now on the same requirements will be before the contenders of the heads of those institutions.

“The Head of the community appoints and dismisses the directors of the medical outpatient clinics being under the subordination of the community, in case of the SNCO, the Head of the Region, – we don’t take any function from the institution. We also fix by the draft the regulation the director can also do paid work in the organization, where he is a director. The Ministry of Health will do the election of the competition holding and questionnaire,” Narek Zeynalyan said.

The Committee member Arsen Torosyan noticed that it is set by the draft is a requirement presenting for the outpatient clinics, primary care centres, the election of the executive bodies of the rural health centrtes, in order the contender will have higher medical education. The MP inquired if unequal conditions will not be created compared with the private MCs, as a requirement is presented by the draft that only the heads of the SNCOs will have medical education, and in response to that Narek Zeynalyan documented that to his conviction, at least medical knowledge and are necessary for managing medical organization.

The Committee Chair informed that the Government made several technical proposals on the draft, which were accepted.

The Committee endorsed the package of the drafts laws.
