“Another victory before the ECHR in a case representing our client, concerning Hague Convention proceedings on international child abduction — this time involving Greece”

In his Facebook post, lawyer Ashkhen Dashyan, an employee of the “Ara Ghazaryan” Law Office, said: “Another victory before the European Court of Human Rights in a case representing our client, concerning Hague Convention proceedings on international child abduction — this time involving Greece.

Today, the European Court of Human Rights published its judgment in Spyridonidis v. Armenia (Application no. 35845/24).

The Court found a violation of Article 8 of the European Convention on Human Rights on account of the excessive length of the judicial proceedings concerning the return of children, unlawfully retained in Armenia, to their habitual state.

The Court held that the proceedings, which lasted approximately 15 months in total, were not compatible with the State’s positive obligation to act expeditiously in proceedings of this nature and with the requirement under Article 8 of the Convention, and the Hague Convention on the Civil Aspects of International Child Abduction, to act expeditiously in proceedings concerning the return of children.

The Court considered the delays at the appeal and cassation stages particularly problematic, as they lasted approximately seven months and two months respectively.

Having found a violation of Article 8 of the Convention, the Court ordered Armenia to pay the Applicant EUR 4,500 in respect of non-pecuniary damage”.
