On February 7, the Parliament debated the issue of electing the candidates nominated for the vacancy of the judge of the Civil Chamber of the Court of Cassation. The Supreme Judicial Council nominated Artur Atabekyan, Arman Ohanyan and Gurgen Malkhasyan for the vacancy of the judge of the Civil Chamber of the Court of Cassation. The issue was debated in accordance with Article 135 of the Law the NA Rules of Procedure.

The Chairman of the Supreme Judicial Council (SJC) Karen Andreasyan presented Artur Atabekyan’s biographical data, his work activity, and touched upon the candidate’s professional qualities.

Artur Atabekyan spoke about the constitutional functions of the Court of Cassation, the role of the separate Chambers operating in the Court of Cassation. According to the candidate, the decisions of the Court of Cassation should have a guiding significance for judges, the legal community, state and local self-government bodies and their officials, legal entities and citizens, should be the basis for solving the legal problems existing in the laws through certain legislative reforms. According to him, justice must be implemented on the basis of the rule of law, the important components of which are legality, legal certainty, prohibition of arbitrariness, access to justice in an independent and impartial court, respect for human rights, equality before the law. “With the complete application of these components, we can consider that the rule of law is ensured,” the candidate underlined.

Artur Aghabekyan referred to the complaints regarding the failure of the courts to investigate the case within a reasonable period of time, expressing his opinion that they have objective and subjective reasons. “It should be noted that the Civil Chamber of the Court of Cassation operates with 7 judges. At the moment, two of them are vacant, and in case of receiving 3000 or more complaints per year, it becomes almost impossible to make an appropriate decision within a short period of time”, the candidate said and expressed conviction that the recent reforms will give positive results in this regard.

“Delayed justice is considered denied justice, and we must have such judicial manifestations in order to ensure the examination of the case within reasonable time frames with our judicial activity, so that the subject applying to the court does not lose the interest in the protection of his rights”, Artur Aghabekyan recorded.

The debate of the issue will continue at the sitting on February 8.

In the last sitting of the day, the deputies will address questions to the members of the Government.
