One of the first victims of post electoral processes was member of “Republic” Party, participant of Karabakh war and commander of “Tigran the Great” Smbat Ayvazyan. The RA Policemen brought him to the police station on February 24, 2008 at about 11:00 pm from Teryan street when he was going home. A Makarov gun was found from his car, and the Policemen made a protocol as if the gun was being kept illegally. The policemen needed two hours to find out that their suspects were groundless, and that Smbat Ayvazyan own that gun legally and the latter showed the permition for that. It seems it would be natural if the police apologizes for such disturbance. But since the main purpose of the authorities was not to find people who keep illegal weapons but isolation and punishment of the opposition, filing a criminal case against Smbat Ayvazyan was of vital importance. Seeing that they do not succeed in filing case of keeping illegal weapons they turned to Plan B. He was brought to the Kentron Police Station after staying 6 hours in the 6th department. Don’t finding any evidence, the policemen turned into Plan C, “resistance”. According to the reports of three policemen, S. Ayvazyan resisted on the way to the “Kentron” Police Station, in the car. Based on those reports S. Ayvazyan was arrested and accused of the 316 article of the RA Criminal Code, and he is still arrested.
The term of Smbat Ayvazyan’s arrest has been postponed twice, though no investigation has been conducted. Smbat Ayvazyan refused to give any evidence since he had not resisted, instead he was illegally kept for 12 hours. There was no sanction for his arrest . Smbat Ayvazyan and his attorney Hovik Arsenyan demand from the investigation body that if they think there is anything criminal in Smbat Ayvazyan’s behavior, send him to the court. “
