The resolution for independence in courts

July 08,2020 22:39

In my opinion, the courts will only be independent when the executive branch ceases to discuss the courts’ decisions in any manner. One might ask what it was like before. I will answer that. It was terrible in the past. The majority of judges at the time were being played by the executive authorities. And it was even worse before that; instead of courts, the “troikas” made all the decisions. But it seems that we should avoid copying the sad experiences of the past. In general, I have come up with a resolution for this. The courts will be independent when those who are dissatisfied with the courts’ decisions will trust in the quality of those decisions, in any case. Let’s say that the majority of our society wants a particular individual to be imprisoned. If the court is doing everything to ensure that this happens, that does not mean that the courts are meant to be trusted. But when the majority of people will say, “What can we do? That is what the law demanded” despite their personal dissatisfaction, that is when we will be able to say that we have a stable judicial system.
