“Information about all prisoners of war, which were identified by relatives through videos, the relatives claim that they saw a manifestation of ill-treatment, identified their servicemen, be it contract or fixed-term, we have submitted an urgent complaint to the ECHR with a request to apply interim measures,” Ani Chatinyan, the lawyer of the Vanadzor office of the Helsinki Civil Assembly, informed during the discussion titled “War crimes: Possible ways to bring Azerbaijan to criminal responsibility” organized by the Media Center.

She mentioned that they have already submitted three applications to the court regarding the issue of servicemen captured as a result of the aggression carried out by Azerbaijan in the sovereign territories of the Republic of Armenia on September 13-15 and continued, “The court has received and sent questions to Azerbaijan, giving a deadline to provide information until 5:00 p.m. Strasbourg time today regarding the life, health, and conditions of detention of captives.”

Ani Chatinyan mentioned that they are currently conducting fact-finding organizational activities, in particular, they have distributed a message with phone numbers to call and provide information about their servicemen. “We are collecting the data, at the first opportunity we are trying to verify information about their location in order to present it on international platforms.” International law specialist Ara Ghazaryan noted that such cases are recorded as a violation, the whole issue is that Azerbaijan continues to use such cases as a means of war.  He said. “Legal processes do not yet have their collective influence to influence the behavior of Azerbaijan.

Naturally, all this should continue until a moment comes when Azerbaijani resources are exhausted, at least in the international legal field, forming a global public opinion that Azerbaijan is a threat to international peace. The label of aggressor was used for the first time in the UN Security Council, although not yet confidently and not by everyone.

Davit Gishyan’s example is a generalized example that shows the policy of Azerbaijan. From 2010, Azerbaijan started escalation, it was clear that Azerbaijan was using it as a tool of war. When the case at the Hague Court enters the final stage, more international entities will start to talk that Azerbaijan is a threat not only in the region, but also internationally. Now only the parties are content to present the incident as a border incident. This leads to the field of absurdity.  I must insist that this is not a border incident.”
